1. Acceptance of Terms
By downloading, installing, or using ClimbingDad ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.
2. Description of Service
ClimbingDad is a climbing training application for boulder and lead climbers. It helps you see today’s session, log hangboard, campus, gym and climbing work, follow a training plan and weekly rhythm, review history and readiness, and optionally collaborate with a climbing coach. The App is provided by Mateusz Kuba ClimbingDad ("we", "our", "us"), ul. Bernardyńska 16b/116, 02-904 Warszawa, Poland, NIP 7621941760.
3. Account Registration
To use the App, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 13 years old to create an account.
4. User Content
You retain ownership of the training data and content you create within the App. By using the App, you grant us a limited license to store, process, and display your content solely for the purpose of providing the service to you.
5. Coach Feature
The App allows you to optionally link with a climbing coach. If you do so:
- Your coach can view training data needed to coach you
- Your coach can send plans and coaching notes that appear in the App
- You can revoke the coach link according to the controls available in the App
Paid coaching. The App itself is free. Some coaches offer paid coaching, bought through a link from the coach. Paid coaching is a contract between you and the coach; ClimbingDad handles the payment on the coach’s behalf. It is governed by separate Terms of paid coaching, which also explain how to cancel (coach.climbingdad.app/subscription) and your 14-day right of withdrawal (coach.climbingdad.app/withdrawal).
6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to the App or its systems
- Reverse engineer, decompile, or disassemble the App
- Interfere with or disrupt the App's functionality
- Share your account credentials with others
7. Health & Safety Disclaimer
ClimbingDad is not a substitute for professional coaching or medical advice. Climbing is an inherently dangerous activity. You assume all risks associated with your climbing and training activities. We are not responsible for any injuries, damages, or losses resulting from your use of training recommendations, readiness scores, workout plans, coach notes, or any other information provided by the App. Always consult a qualified professional before starting any training program.
8. Availability & Changes
We strive to keep the App available at all times but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features at any time. We will make reasonable efforts to notify you of significant changes.
9. Account Termination
You may delete your account at any time by request, as described on our account deletion page. When you delete your account, associated data is permanently removed as described in our Privacy Policy. We may terminate or suspend your account if you violate these terms.
If you have an active paid coaching subscription, we cancel it with our payment provider before deleting your account, so you are not charged again. You can also cancel it yourself at any time at coach.climbingdad.app/subscription.
10. Intellectual Property
The App, including its design, code, and content, is protected by copyright and other intellectual property laws. You may not copy, modify, or distribute any part of the App without our written permission.
11. Limitation of Liability
To the maximum extent permitted by law, ClimbingDad and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to physical injuries, data loss, or loss of profits.
12. Governing Law
These Terms are governed by the laws of Poland. Any disputes shall be resolved in the courts of Poland.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes through the App or by email. Continued use after changes constitutes acceptance.
